KENWOOD won the first trial of lawsuit against manufacturers of imitation
products for infringement of trademark and design right in China
KENWOOD Corporation (President & CEO: Haruo Kawahara; Head Office: Hachioji, Tokyo) had filed a complaint to Beijing First Intermediate People's Court in China against Beijing Yichangyuan High Technology Co., Ltd., Fujian Top Way Intelligent Science & Technology Co., Ltd. and Fuqing Rongwei Communications Co., Ltd. on charges of 1) trademark infringement and violation of the Act Against Unfair Competition; 2) copyright infringement; and 3) design patent infringement in wireless radio equipment.  The Company won in the first trial of the aforementioned three cases.

KENWOOD filed a lawsuit to Beijing First Intermediate People's Court in China against Fujian Top Way Intelligent Science & Technology Co., Ltd. and Fuqing Rongwei Communications Co., Ltd. on charges of trademark infringement and unfair competition for selling their wireless radio equipment, and the instruction manuals of these products, violating the Company’s copyright.  In addition, the Company accused these companies of design patent infringement by producing and imitates KENWOOD’s product. In the lawsuit, KENWOOD demanded that Beijing Yichangyuan High Technology Co., Ltd. (retailer) discontinues the sale of products.  The Company also demanded to suspend production and sale of imitation products against Fujian Top Way Intelligent Science & Technology Co., Ltd. (manufacturer) and Fuqing Rongwei Communications Co., Ltd. (distributor) as well as compensation for damage from them.(At the same time, KENWOOD has applied to Intermediate People's Court of Fuzhou city, Fujian Province requesting that an injunction be placed on Fujian Top Way Intelligent Science & Technology Co., Ltd. to stop it copying and distributing software to set the frequency on our wireless radio equipment.)

In the ruling at the end of last year, Beijing First Intermediate People's Court fully recognized the claim filed by the Company and ordered the three defendants to suspend the manufacture and sale of imitation products, publish apologies in magazines and on their websites, and pay a total of 4 million yuan (approximately 60 million yen) to the Company as compensation. In reaction to this, Fujian Top Way Intelligent Science & Technology Co., Ltd. has filed an appeal to Beijing High People's Court.  KENWOOD will make an all-out effort to have the lower court’s decision upheld.

KENWOOD is taking a firm stance in its confrontation of companies that produce counterfeit or imitation goods, by identifying them and accusation to the authority of the government or filing lawsuits.  We will retain our basic stance of protecting consumers and the interest of the Company across the world, and continue to promote activities to eliminate infringement more strongly against these illicit companies and imitation product manufacturers, based on our intellectual property rights.
