KENWOOD Wins Second Consecutive Design Infringement Lawsuit in China

To authorized distributors and dealers of KENWOOD communication equipment:
We are pleased to inform you that a Chinese court has recently ruled completely in KENWOOD's favor as regards our lawsuit against Kirisun, a manufacturer of counterfeit radios. This is the second successful design patent infringement lawsuit in China. (We reported on the first one against HYT <Shenzhen HYT Science & Technology Co., Ltd.> in our previous newsletter).

September 29, 2004
  • Kirisun Electronic (Shenzhen) Co., Ltd. shall immediately suspend all activities (production and sale of the PT-278/378/388 radio equipment) which infringe the design patent (No.96301270.3) owned by the plaintiff, KENWOOD Corporation.
  • The defendant, Kirisun Electronic (Shenzhen) Co., Ltd., shall indemnify the plaintiff, KENWOOD Corporation, for the incurred loss in an amount of RMB200,000 (approximately US$24,000.)within 10 days of the date this court judgment takes effect.
  • The litigation cost shall be borne by Kirisun Electronic (Shenzhen) Co., Ltd.
The above court judgment became final as the defendant did not appeal to the High Court.

Following our successful design patent infringement lawsuit against HYT, a Chinese court found that the imitation product manufacturer was in violation of the law. We are determined to take the strongest possible measures against such manufacturers of illegal copies of our products hereafter and appreciate your further cooperation in eradicating product pirates and their illegal acts.
